Hello buddies! Since 50's Internet has evolved at various level. From CERN project to global infrastructure, internet has turned our lives to new era. The developers of World Wide Web decided to keep the project free. They wish no one have control over the network worldwide. They created free and independent environment for sharing ideas, concepts, data, etc. Internet has transcended boundaries and reached billions of lives. Internet is like a nation without boundaries. But with present day internet is hogged with restrictions and filters placed by state agencies.

Mistakes Happened in India

India, which is known for it unity in diversity have traveled long way in the History of this world. With unique multi-culture society, India is home to vast number of people. For a country which has faced numerous invasions and conquest, multiculturalism is not a surprise. As the child grow up to an adult in the society, the level of socialization increases. The process of such socialization is done by three important social institutions:
    • Educational Institutions
    • Health Care Institutions
    • Family

Failed States

To all people, who lived during the period of cold war, know the two great ideology for the life-time. One is lassiez-faire and another communism. While America created a new department to take down the propagation of communism in U.S.A, U.S.S.R aggressively propagated the ideology. The contention among the two great world powers is not the influence but the ideology that they believe in.

With U.S.S.R disintegration, propagators of capitalist rejoiced that the ideology in which they believed survived the odd times. The follow up  events showed that free markets are the only way to keep a sustainable society.  That was evident from the reforms carried out by many closed economy countries. But the communist state failed to note that closed economy is not the way achieve economic success. Neither authors or commentators of communist ideology favored closed economy to meet it ends while pursuing communism. 

The states which experimented with communism failed to take cue of the idea behind it. That was the real cause for the failure. Instead of working class owing the forces of production, state decided to own it on behalf of working class. The individual capitalism which was popular in the capitalist countries were transformed in to state capitalism. This is the root cause for the failure. The real communist idea was to make working class have control over the force of production. But in communist state, state took the place of the individual capitalist. So, the result was worse than expected. 

The result was that the states which pursued communism were seen as state which strike terror in the heart of citizens. An insecure sense in the society. The forfeiture of assets owned by individuals was the worst part. In no part of the communism, it was told to forfeit the rich. The anger against the capitalist class helped to built those communist state. That was one among the many mistakes causing downfall of these states. Communism is not about usurpation of capitalists.

The Communism is not a mere failed ideology. It still has potential of its own. Still workers can own force of production. The great example is cooperatives where workers or craftsmen who are in need of capital can pool their resources to create a great production force. The profit are shared among the members. It is not mandatory to establish them only in the communist state. Any society can develop cooperatives. When workers or group of individuals feel they can't meet their ends with the present way, they can peacefully form such organisation among themselves. This don't need any drastic change or weapons to change their lives or others. Only the will and good organisation skills were needed. This is the real communism and not changing into a state capitalism.

Even in strict capitalist states, communism is followed in disguise. One great pick would be partnerships. Where people of common interest work together to achieve their goals. Their might rise a question, how it benefit the working class! Communism is not only about working class, it about collective work whoever it may be. In strict capitalism individuality is the norm while collectivism is for communism.  The target of communism turned to be working class as these people had no control over the forces of production. Even in partnership, each individuals don't have means to have control over the forces of production. Hence, they decide to own collectively the production force. Either way, it appears same but for the names involved.

Contemporary Convictions

Good day people. We would have heard about convictions of offenders involved in crime through our mass-medias. The convicts are proved guilty based upon a code which is law of the land. While the code is of substantive nature which provides various provision for punishments against a specified act that is declared as wrong in that society.

While it may be seen as naive to question the code upon which judiciary functions, but soon it may emerge contingent to question the code as change in the society might make the present code sterile and dysfunctional. The code is the primary source of remedy against a wrong committed by the convict. Hence, the question is what constitute a wrong in a society? All right, the time has arrived to correct the deficiency in the contemporary justice system. All we do is just punish the person who has committed the wrong. Does it have end in itself? A deep thought answer is no! Just punishing or terminating the offenders out of the society is just a temporary solution. To sustain a society, punishments are not alone sufficient pillar to build a community.

The other view of the justice must be addressed at this juncture. The cause of such an act deemed to be wrong to be found out. What may appear to be wrong to us might appear correct from perspective of the others. The ideology on which the society is built provide the supportive clause for the act declared to be wrong. Precisely , the person who acted against the ideology of the society is deemed to be wrongdoer. Indeed, for a person who is deviant from the social norms of the community should be treated with great care. Rather than punishments, a correctional facility is the way to bring such person back into the fold of the ideology of the community. But the present day Judicial system in most nation fail to address the need of correction. They act only as an institution of fear and keep the delinquent undercover.

The contemporary system promoted the value that unless you get caught nothing done is wrong. The socialization which evolved for many centuries failed to address bringing back the delinquent person who is a wrongdoer for the community in which he lives, in line with the ideals of the community. On the other hand, it developed a stigma around the delinquents which further antagonize them.

In order to provide stable community, a balance must be struck between punishments and corrections of delinquents. It said easier than getting it done. It is slow and steady process and must be build with great care.

Final Match of the first Hero Indian Super League

The high drama ended on Saturday night the moment the referee blown the final whistle. The starting line up was with a little surprise. Atletico de Kolkata resting Luis Garcia and Kerala Blasters Marquee player James presenting himself with the work of goal keeping. Both the teams employed a balanced approach towards the game. The formation of Atletico de Kolkata  seemed to be aimed at getting at least four players to lay siege at goal. On the other hand, Kerala Blasters fielded five players against Edel.

Both the half of the game saw high action. But failed to break the stalemate. Slew of yellow cards and fouls further added fuel to the fire. James and Edel kept the score board nil until Rafique found the back of the net. While both the team were anticipated to play extra-time, their came a pass which turned to be the match winner. Edel who kept a strong last line defense against Kerala Blaster made a splendid save of the match against Michael Chopra.

The questions left unanswered were answered in the finals of the Hero Indian Super League. +Atlético de Kolkata clinched the title and will always be remembered in the history of Hero Indian Super League as first champions.

The Golden Boot award won by none other than the Elano Blumer. This was anticipated even prior to the Semi-finals kick-off in Hero Indian Super League. Beyond that, Elano Blumer donated the prize amount for the development of Indian football.

The Golden Glove won by the Jan Seda. He made FC Goa get into the semi-final of the Hero Indian Super League by maintaining a clean sheets at the crucial moments of the league matches.

Tonight, India going to witness a grand final of the Hero Indian Super League where Atletico de Kolkata faces Kerala Blasters FC. We have left with 6 hours to kick-off the final match. Too much speculations about the winner. But to the shock and dismay too much controversies building up in the Hero Indian Super League.

With Ravshan Irmatov to officiate the final match, the veracity of decisions are being challenged prior to the match. The Controversy with Luis Garcia Goal which was disallowed against Kerala Blasters in the League table match and the poor decision on the hand ball still haunt Atletico de Kolkata who are in the finals of the Hero Indian Super League. To add to this injury, they will watch the same official officiating them against the Kerala Blasters. This kind of moves in Hero Indian Super League would raise suspicion over the officials. Discussion were started in social media with comments that ISL bosses want Sachin to lift the Trophy as first champions on this inaugural season of Hero Indian Super League. Even though, those are informal talk between fans of the clubs, it can't be brushed aside considering the gravity of event built-up in the Hero Indian Super League.

But these characteristics are not limited only to Hero Indian Super League. To err is human. But consecutive errors are unforgivable. Such controversies make fans lose zeal over the tournament. It all common when a referee fails to note a genuine fouls made. Since the flow and pace of the match might over shadow the foul. But excuses must be limited. Denial of legitimate goals will make bad jokes and sarcasm on the future.

Emergence of Kerala Blasters from nowhere to the finals is applauded. But that doesn't set right the controversies behind the decisions. We fans hope at least by next season of the Hero Indian Super League goal-line technology is not only placed but also working. For us, it is no surprise if Kerala Blaster lift the title this season. Yet, Atletico de Kolkata will be unrelenting to concede. Tonight, the air will be cleared at Navi Mumbai.

Good day folks! We are at the end of the inaugural season of the Hero Indian Super League. The high drama to be ended with Atletico de Kolkata and Kerala Blasters clashing in the grand final match to be held in Mumbai tomorrow. It's premature to predict results of the match since the Hero Indian Super League has seen unexpected twists and turns. The expected top contenders who created huge buzz with bringing in top strikers and midfielders failed secure the top spot. Really loved to watch such an action sports. In the end, they all proved that a team is not less than others in this tournament.

From the league matches held between the two team in which both the team drew the first match between them and Kerala Blasters ended up winning against Atletico de Kolkata . But that was with an abysmal margin of one goal. We are not interested in the debated hand-ball for now.

For Luis Garcia's men, the task ahead is tough. Consistency in the performance is the need of the hour. The Semi-final between FC Goa and Atletico de Kolkata ended inconclusively with a goalless draw till 120th minute of the match. The Strong eleven men of Atletico de Kolkata could be kept away from goal if the Kerala Blaster maintain a good d-line which has high probability to break once concerted team effort is exerted by Atletico de Kolkata. Kerala Blasters were startled with conceding three goals against Chennaiyin FC. Had the Chennaiyin FC turned few chances into goals, it would have crashed out Kerala Blasters of the tournament. So, the team Kolkata might try hard to keep good tactics on field.

Atletico de Kolkata is well known for its rough defense play. Tight marking and covering spaces would make Kerala Blasters rethink their attack play. Atletico de Kolkata has displayed an unrelenting play when it comes to defense. No easy goals against Kolkata pals! But Kerala Blasters are turning good at converting few mistakes into an unforgiving goals as they did in Semi-finals against Chennaiyin FC. The question is how consistent will team Kolkata be in its defense against Kerala Blasters! The match against FC Goa, Atletico de Kolkatta suffered some deficiency in defense. For an instance, a cut-in by the winger, Romeo Fernandas, led to a shot against Kolkata but the shot saw the wrong side of the net. Complacency has no place in football. Nevertheless, no team is immune from any attack unless well coordinated defense is in play. Conversely, some believe attack is the best form of defense.

Final match of the Hero Indian Super League is the only answers for the question that go unanswered. Dynamism in this tournament has made every future match unpredictable. One thing will happen for sure irrespective of any predictions, both the team will spice up the game tomorrow night. Lets football!

Second-leg Semi-Finals of Hero Indian Super League: FCG V ATK

The second-leg of semi-finals in Hero Indian Super League between FC Goa and Atletico de Kolkata held in the home-town of FC Goa. The first-leg of semi-finals between them concluded with a goalless draw. The expectations were high on FC Goa as they did some fireworks in the first-leg semi-finals with good enough shots on target. Atletico de Kolkata rode on its team power and experience.

Both the teams were fierce contenders for the final berth to be held on Saturday night. FC Goa didn't fail to rock the night . They created numerous opportunities but the ball denied FC Goa with a goal. Andre Santos who not only made numerous shot fly over the goal post but even the penalty kick followed the same pattern. Santos free-kick disappointed the home crowd. The set-piece at which FC Goa were strong at crumbled once Santos over shot them. Romeo found the wrong side of the net at a scoring opportunity. Mandar cut-in on occasion added pressure to the Kolkata defenders. But it was finally Atletico de Kolkata were into the finals against Kerala Blasters in the inaugural season of the Hero Indian Super League. FC Goa lost composure of the game. Might be due to the pressure either from home crowd or to a 'must score' situation.  The other side is Kolkata kept pressure upon the forwards of FC Goa. Anyhow, they yielded to Kolkata.

Atletico de Kolkata did great. It appeared as if they have been training the team for the penalty kicks. The power and the balance exhibited by the players were authentic.  But lucky team, saw few penalty kicks played by FC Goa wide of the goal post. 

One beautiful thing about the penalty kick held yesterday is that no goals were saved by the goalkeepers of either teams. To be precise, FC Goa missed shots during penalty kicks which let Kolkata into the finals in this Hero Indian Super League. And for the finals Best of luck Kolkata. FC Goa live for another day.

Post Second-Leg Semi-Finals of Hero Indian Super League, CFC Vs. KB

The pre-match analysis turned to be true that Marco Materazzi boys rocked yesterday night. Marina Arena roared like thunders when the CFC scored 3 amazing goals that shook Kerala Blasters. Despite the unfortunate goal from Kerala Blasters' Pearson in 117th minute, the game was amazing.  One goal difference kept CFC out of finals in Hero Indian Super League but won millions of heart. No other team might rock in Hero Indian Super League as did by the Chennaiyin FC.

Materazzi revamped the entire attack. Mendy attained new dimension in the team, took some attack over his shoulders. The cross by Mendy was exemplary. Unfortunate CFC, missed few scoring chances. But it all happen in a football. After all, life is all about unexpected surprises and disappointments.

This first season might be considered as good start for Chennaiyin FC. Even though they lost, they won, not the game but millions of hearts. The high spirit even during the last minutes of the game made the entire fans proud. Fans expect the same momentum in the next season of the Hero Indian Super League.

And for the defense, Silvestre interrupted crosses from Kerala Blasters. The tight marking of forwards kept the Kerala Blasters at bay. Hats-off to the d-line. For a team which was less spoken about, they rocked.

The Latest development in Chennaiyin FC is in process of finalizing deal with Inter Milan, erstwhile Marco Materazzi team, to train it youth team with a huge investment of Rs. 2 Crores. A step ahead to breed young talent with great affinity towards the club. Sooner or later, we will watch some new young talent rock the Marina Arena.

Second-Leg Semi Finals - Hero Indian Super League

The first-leg semi-final match between FC Goa(FCG) and Atletico de Kolkata(ATK) ended in a goalless draw. But it will be premature to conclude anything at this point. While FCG has a sluggish start in the season. Later, the Zico boys rebound from nowhere to get semi-final berth in the Hero Indian Super League. For ATK, football is a religion. It is a usual for the Kolkata football fans to conduct special ceremonies for their favorite team win. Nevertheless, both team were from the places where Indian football was groomed.

Whereas the ATK which had a huge buzz from the start of the league matches, no surprise, they played well. The Luis Garcia and Fikru combo did some magic on field. Fikru was a speeding bullet to dodge past the last defender to score goals. Luis Garcia was kingpin of the team attack. A target man who could lead the team to the goal post in no time. And for the defense, ATK is well known for the rough-up play against other teams. Constant marking and pressure has spoiled may attack against the ATK. Subhasish Roy Chowdhury, the Stronghold Guardian of the ATK, stand as a tall wall against any shot at target. But in the First leg Fikru was rested. The gaffer is planning on him! The team is good at making rival defender run from pillar to post. The One touch passing and switching sides of the play create numerous opportunities.

The Strength of the team is with long balls as long as  Fikru is good at catching up with them. The solid defense line and close player support at crucial time pressurizes the opposition.

While, at present, none can under estimate the FC Goa. Zico proved him to be the man of words. He assured the team will rebound to top after the consecutive defeats at start of the Hero Indian Super League. Now the team is one of the strongest contender of the title in first Hero Indian Super League. The indigenous talent Romeo emerged as real hero to win hearts among the crowd who scored the 100th goal of the Hero Indian Super League.  Romeo Fernandas is state-of-the-art indigenous footballer in the Hero Indian Super League.  His incisive runs, talent to create huge space for the attack made him an outstanding player of the tournament. To add further, the André Santos deadly strikes add teeth to the FCG. Miroslav Slepička, made a good contribution towards the team victory in the last phase of league matches. Especially, the conversion of loose ball into goal which was splendid. Slepička keeps up the form them he will be unbeatable goal-machine of the Hero Indian Super League.

The strength of FCG is set-pieces. Defenders are good at converting the chances to goal. Fast and pacey attacks. But in the First-leg of the semi-finals in Hero Indian Super League, FCG would have scored four goal but for the lack of composure from the strikers.

The odds favor FCG looking at the recent attack and defense they showed up in the game. But that doesn't conclude. ATK might cast its spell in any match minutes.

The first leg of the Hero Indian Super League semi-finals between Chennaiyin FC Vs. Kerala Blasters in which Kerala Blasters took a clean 3-0 lead against Chennaiyin FC. Today, the second leg to held in Chennaiyin FC Home town. Speculations are that Chennaiyin FC will never lose before its Home crowd. Hope, it will be forever. As for as the first leg of the Hero Indian Super Legue semi-finals between these two team, Kerala Blaster stood tall. It coverted every mistake into an unforgiving goals against the Strong Chennaiyin FC. Too much space in defence, weak marking of players has cost Chennaiyin FC in First leg of the Semi-finals. Special thanks for Sushanth Mathew of Kerala Blasters for the spectacular third goal of the match. No goal keeper will find it easy to stop such a curler. But this is not the end. It's football! Unexpected things happen. Chennaiyin FC still has some fair chance to rebound in the second leg while Kerala Blaster could  still contain its rivals with some pressure on their attack. Either way is possible.

Chennaiyin FC has got legends in their ranks when it comes to defense. But the problem which was evident in the first-leg of the semi-finals in the Hero Indian Super league was lack of co-ordination in defense. Man-marking and covering seems too weak. Each of the defenders, Nesta, Suarez, Mendy, Silverstre stood tall individually. This wouldn't be enough. A well-planned defense line should stop the Sachin's men from scoring goals further. Come on people, with Marco Materazzi as head coach this is a walk in the park for Chennaiyin FC(CFC). But this didn't work out for no reason! Best thing for the CFC is forget the past and move on with good plan in the second-leg. Despite the few mistakes, Mendy stood tall at times with his early crosses, trying to create good oppourtunites.

With the attack, indigenous products Jeje and Balwant Singh did well in the league table matches. But against Kerala Blasters in the first-leg, they found their foot weak. Jeje could have scored but for his shot power and Balwant Singh could have added some attack to keep pressure on the Blasters. Mendoza out of the equations this duo combo must create opportunities for the team. The strength as well as the weakness of the CFC attack is dependence on a single play-maker either Elano or Pelissari. Marking these play makers reduces the scoring chances of CFC. But Mendy has explored other possibilities in the first-leg match with his early-crosses. Hope, other players follow suit with unpredictable passeses to break open the opposition defense. Further, the attack needs variations with dummy runner, overlap to break ice in the opposition defense.

With unrelenting head-coach Materazzi, CFC might rebound in the second-leg semi-final match of the Hero Indian Super League. Let's Football!

Hungry Shark Evolution Survival Guide

From the previous post, you would have known about the basic of the Hungry Shark Evolution. But it's not all thing. Feeding your hungry shark would look simple in words but they need some skill especailly if you decide to survive for long time. To access secret shark lab in-game, you need a score of 500000 in one game. In order to acheive that, you need to make sure your shark survive the hard test. As I said in the previous post, you can simple feed on other organisms. But after a while, you may notice that you don't find anything to feed on. So the first trick in survival of your ever hungry shark is not to stop in single area. Move the hungry shark constantly to new places. Some secret place near the rock will give your hungry shark an awesome feast.

The Game play start with your shark dropped into a sea. Once you unlock a different shark the drop place would differ. To be true, it doesn't make difference. Once, I unlocked the second shark in-game, I moved my shark to right of the sea through a pass which is present under water to find the place where the previous sharks was dropped. So this is the trick. Don't stay in some place for too long. Get a feast and move to your right, find the pass so that you could find new place to feed your hungry shark. After a while, vice-versa.

And one more important point in Hungry Shark Evolution is not to stay under water for too long. Before you move to new place, check the surface of the sea. You will find some swimmers. Snack them and move on. Eating those swimmers give good boost to the health bar. If you are lucky, you may find a group of swimmers near the shores. But if you find no swimmers then just move on to next place. One of the secret in Hungry Shark Evolution is not to wait for the prey but search for the prey. Remember! It's Hungry Shark. So feed them until you find nothing to feed.

Occasionally, you will find mariners near you. And also when you unlock new shark you will get chance to eat other hungry sharks inferior to your hungry shark which travel around you. A point remember is these sharks around are capable of nipping your shark. If you find a group of sharp nipping you, be quick at eating them or else your shark will die of incessant nipping. So stay sharp, first strike is your advantage. Don't spare them, make use all of them.

Mines: One of worst enemies in-game for your sharks are mines. Once you level up in-game, more  mines and bigger they become. At entry level, you will find them in deep water. Once you unlock Tiger Shark you will start finding mines even near the shores and mines will be floating in water. So easy hunting on shores are difficult. But this should not inhibit your hungry shark from feeding on humans. You will always find a way to dodge past those mines. You might get hit by some small mines but bigger mines are unforgiving. They will take heavy toll on your shark health. The worst part is jelly fishes halting around mines. If you are unlucky, instant death is the result. To your surprise you hungry shark will encounter mines at the exit of the pass. But this don't pose a danger as you can take a steep dive upwards at the end of the passes. Be advised not to boost your shark in hurry when you are in a under water passes as you will start tackling mines even in passes. Plan your hunting spot before it's too late to make a move.

Submarines: Apart from mines, you will encounter a bigger threat. Yes! Torpedoes will be fired at your shark. Just take three hits and your hungry shark is dead. Those torpedoes are propelled from a submarine. So take those submarines head on with your sharks. Boosting your shark will help. But remember when you get hit, your shark will move away from the submarine. So try to hit the submarine hull from different directions. Submarines are quick to align them against you so boost and quickly take the submarine out of the equation. Make random moves until your shark is near the target submarine. Hit them with boost to make it harder. Voila! The submarine hull will break open. The Pathetic situation arises when two submarine approach against your shark. Make sure your shark take on one submarine as soon as it appear on screen. In most situation, two submarines will approach from either direction. So cowardice will not help! You can run but fight against them is way for the survival. Ramming your hungry shark anywhere on the submarine will break open the hull. Whatever said here, you must try it yourself. You can teach yourself better than anyone when it comes to hungry shark.

Mariners: The third and less dangerous threat in this game. Mariners are little threat except for the spear attack launched by some pathetic mariners. Mostly they will end up at the jaws of the shark. One or two mariners may accompany a submarine to launch an attack occasionally. Always try to bring down the submarine. If you get chance, take the mariners on your way to attack submarine.

Useful Add-on: Try to unlock laser gun for your hungry shark. They are very effective. They will paralyze your target for a brief time. We will get a bonus score for feeding on paralyzed targets. For example, Consider a submarine accompanied by two mariners. The laser gun will paralyze the mariners in no time so you have take on submarine without much worry. Even other sharks will be your prey once they are paralyzed by your laser gun. Not only under water organisms are targets but also swimmers and fishing men shall be paralyzed with your laser gun. Hungry Shark Evolution Guide

Are you wild-life lover? Or dreamt of the deadly man-eating shark! Nothing will stop you from grooming a shark now. But it's a virtual reality. Remember!.

Hungry Shark Evolution is one of the best game available in the Google Play Store. All you have to do is to groom the sharks to its full capacity. Grooming a shark needs a lot of zoological skill! It sounds skeptical at first, doesn't it? After all, this is just game. So all you have do is feed them until they grow bigger.

Game Play: At the start of the game, you will be provided with "Reef Shark". The very basic one. The game play is quite simple try to eat all the fishes and other marine organs to grow your shark. But stay away from jelly fishes and spiking prawn & fishes (I am not a mariner).
Unlike human beings, these sharks need to be fed all time. In the top right corner a bar will indicate the health of the shark. It starts depleting slowly but at a constant pace. Once the health bar is empty your shark will die of starvation. Hence, keep feeding it all time.

And remember the stats of each shark you play. Don't go too deep in ocean. They have limitations when it comes to depth. Example, the "reef shark" will withstand 90 meters. Beyond that you shark dies too fast. The game indicates when you reach shallow waters. So, you can adjust your depth to the comfortable height.


Feeding: As I said earlier, Your shark, whatever shark you get from the game, must be fed infinitely. So you have to chase prey around you. This can be done using the controls which direct the movement of the shark. Two type of controls exist. One with the help of sensor where you can tilt the device. Second method is to tap & move on the left side of the device.

Once you start moving you will catch some easy prey near you. Your shark will eat whatever prey adjacent to the jaws. This is not the only control. you can boost the shark to watch the real action. Even though this is a game, it simulate the reality. Once, your shark move near the prey, the prey will move out of the path. Especially, when your shark hunting in the coastline shore and while hunting some innocent swimmers. To get them off-guard, you can tap & hold anywhere on the right side of the device screen. Your shark will move at high speed and have the prey.

Evolve your shark: Shark grooming don't stop only with the feeding. But evolving the shark. Sounds confusing!!! What is evolving? It's nothing but upgrading your shark. Use the coins collected during the game to upgrade the three following skills:

  • Bite, 
  • speed and 
  • Boost. 
Apart from this basic attributes, your shark can be fitted with accessories such as skate board, laser, jet pack, shark vortex and so on. Each items are unlockable either using coins or gems collected from the game depending upon the particular item.

By feeding, you can reach level 10 for the shark you are playing. Once you reach level 10, the next shark in the order could be unlocked. Evolve the newly unlocked shark to its fullest capacity.

Advanced movement: You can perform some spectacular stunts with your shark. You not only find prey in sea but also in air. Birds flying at low level over the sea could be hunted with a high jump. To do an high jump, get some depth from the surface and move the shark upward simultaneously applying boost. Once, the shark reaches the air it will hunt any prey in air. This trick could be used against people fishing in boats. Just do a high jump and board the fishing vessel, the rest is taken care by the shark. But make sure it deboard the fishing vessel as soon as possible by moving your shark. Always remember your shark energy will be depleting at constant pace. And also the boost is limited. The bar below the health bar indicate the boost available for your shark. It will replenish gradually once you start feeding. So use them wisely. Don't waste your boost energy for small fishes.

Protection of Child Under Domestic Violence

In accordance with the guidelines laid down by the UN organisation for protection of Children against abuse and domestic violence. The Domestic Violence Act, 2005, in compliance with such provisions of UN has placed a safeguard against the abuse of children of the victims under Domestic Violence act. The Act 43 of 2005 not only protect the woman from domestic violence but also protect the dependents of victims, especially children.

Object of Custody Order


Section 21 of Act 43 of 2005 protect the children of the victims against the Domestic Violence perpetuated against them. It entrust the temporary custody of the children of the mother who is victim of Domestic Violence. Any wrong committed against mother may affect the children directly or indirectly. Hence, the object is to protect the children from abuse to which the child may be subjected, directly or indirectly.

Reason Behind such Order


A natural presumption when it comes to the care of children is that mother would take care of her children than any other person. Hence, under section 21 of the Domestic Violence Act, secure the temporary custody of the children to the affected woman (mother of the child) while the application of the aggrieved person is being considered by the Magistrate.
If the situation deems fit an arrangement shall be made for the respondents to visit the children. Even then, if the Magistrate thinks fit that such visit by the perpetrators of Domestic Violence, is harmful or not in the interest of children, then the Magistrate shall refuse such visits by the respondents.

Monetary Relief Under Domestic Violence Act, 2005


Monetary relief, which is also called as compensation, is an order passed by the magistrate in favor of the victim under Domestic Violence, for any loss or expenses incurred by the victims as a result of Domestic Violence. The victims would include the children of the woman who suffer Domestic Violence.

Remedies available to Victims


The Magistrate, to whom the application was made, may pass an order after providing an opportunity to the person against whom such reliefs were sought by the applicant/victim. The order may contain the following but the order so passed is not limited to following. The Magistrate may pass compensation to any other acts which has resulted either directly or indirectly towards violence against the victims.

The following are the remedies available under Monetary relief which are included in the Domestic Violence Act:

  •  For any loss in earnings to the victims which was caused by the persons accused of Domestic Violence.
  • To compensate for the expenses incurred by the victims while under going any medical treatment.
  • To compensate for the loss resulted due to the deprivation of the property from the victims. Such property includes the properties held jointly or stridhan.
  • For maintenance of the affected woman and her children. This relief may include or in addition to the sec 125 of Cr.P.C.

Effect of Non-Compliance of Order

If the person against whom the above mentioned order was passed by the Magistrate and such person fails to comply the order, then the Magistrate shall issue directions as follows:
  • To direct the employer/any debtor of the person against whom a monetary order was passed, to pay the money in favor of victim or deposit in the court. In case of Employer, the Magistrate shall order for deduction of certain amount periodically from the salary of the employee against whom a monetary relief order was obtained, until the amount mentioned in the order was paid to the victim.

Calculation of Relief amount


The Act 43 of 2005 has not placed any yardstick to measure the amount of compensation payable to the victims. But places a guideline in motion under Section 20(3) of Domestic Violence Act, 2005.
It states that the monetary relief shall be to the extend so that aggrieved person shall meet her standard of living to which she is accustomed. The amount should be such that it will be able to meet the needs of the victim. The standard of living of the victim to which she is accustomed should prevail as it is.

Residence Order


What is a Residence Order?

The basic needs of human being are food, clothing and shelter. This residence order provides shelter for the woman who suffer Domestic violence. This one among the orders that may be passed by the Magistrate under whom the adjudication of the application falls.

What Order shall be passed?


The Magistrate may pass any order on being satisfied that prima facie domestic violence occurred. The order may contain the following:

  •  To restraint the person who is alleged to have committed domestic violence (respondents) from dispossessing or disturb the possession from the house where she is residing.
  • To direct the respondents to be evicted out of the common household. But this provision shall not apply to persons who are women.
  • To restraint the respondents or their relatives from entering the portion of the household where the affected person and dependents resides.
  • To restraint the respondents from alienating or disposing the shared common household
  • To direct the respondent to secure an alternate accommodation for the affected person.
  • The respondent not to stop paying any rent and other payments related to the common household where the applicant and respondents reside.

Limitation of Residence Order

The residence order shall not lie against in-laws of the affected woman. Even the third and fourth condition mentioned above is applicable only when husband is a member of joint family.

Other Orders along with Residence Order

The Magistrate may as he thinks fit depending on the case shall direct the respondents to execute a bond that they shall not commit any act of Domestic Violence in the future. This is to protect the interest of the affected person. Persons against whom an application was made may threaten or evict the applicant from the house. Hence, if the situation needs, the Magistrate may direct the respondents to execute a bond abstaining from Domestic Violence.

Implications of Residence Order

Under section 19 of the Act 43 of 2005, applicant and the respondents can reside under the same roof even though, the application remains pending before the court. The most common social tendency, particularly in India, is to send the girl out of the matrimonial house the most she tries to take a legal recourse against husband, in-laws or relatives. The most weaker section of the society are women and their children. Hence, the section 19 of the Act of 2005 was well crafted to satisfy the social appetite and secures the vulnerable group of the society. 

This section has distinguished significance when the affected woman and their dependent children lacks support from both the matrimonial and parental house. This particular section provide protection and have perpetual impact upon the dependent children. Hence, prevent psychological and emotional distress and prevent the children from turning into a future deviant in society.

For women who completely depend on their husband or relatives for the financial needs, this is a life-saver.

Protection Order


What is a Protection Order?

Under the Domestic Violence Act, 2005, the Magistrate was conferred with vast powers to issue any order as he/she deems fit for the benefit of the woman who suffer from act of Domestic Violence.

When the Protection Order shall be passed?

The Magistrate shall pass a protection order in favor of the affected woman which includes the dependents of the affected woman especially children.
The Magistrate may follow the Principles of Natural Justice prior to the disposal of the application which prays for relief against the person committing an act of Domestic violence. The Magistrate shall provide an opportunity to the respondent or the person who alleged to have committed the act of Domestic Violence to put a defense statement against the application.
If the Magistrate is satisfied that prima facie case is made up against the respondents, the Magistrate shall pass the Protection Order in favor of aggrieved person.

What shall the Order contain?

The Magistrate may pass a Protection Order which shall prohibit the following act by the respondents.
  • From committing any act of domestic violence.
  • From aiding or abetting a act of Domestic Violence
  • From entering the work place of the applicant, in case of woman, and schools or any other place, in case of children.
  • communicating to the applicant/ aggrieved person in any form.
  • To alienate any assets, bank lockers or accounts held either singly by the respondent or jointly by the applicant and the respondent
  • To alienate applicant stridhan or any other property which being held jointly or separately by the parties.
  • To cause any act which constitute Domestic Violence against the aggrieved person's dependents or other relatives or any person who provide assistance to women who was subjected to Domestic Violence. 
  • Any act which magistrate may thinks fit that it ensure the protection of the aggrieved woman and the dependents.

Exception:

In case of properties held by the parties, such properties shall be alienated/sold with the sanction of the Magistrate under whom the application is pending for disposal.

Service Providers under Domestic Violence Act


In the previous post, the procedure involved in the adjudication of Domestic Violence case before the Magistrate was stated.

Now, it's time to address the various service providers who can involve themselves voluntarily in the aid of the affected woman.

Who are all service providers?

Any voluntary association shall be a service providers. And such voluntary organisation must be either registered under Societies Registration Act, 1860 or it must be a company registered under Companies Act or in accordance with any other law for time being in force.

Every voluntary organisation must register themselves with appropriate State Government as a service provider.


Difference between Service Providers and Protection Officer

One of the primary distinguishable difference between the both are the mode of appointment. While a Protection Officer is appointed by the concerned state government for each district, the service providers on the other hand, is a voluntary association, out of it's own interest, who provide service to the affected woman under domestic violence. 

Even though service provider being a voluntary organisation, it's at par with Protection Officer on some part.

Service rendered by the authorized Service Providers

  • The primary object is to protect the rights and interest of the woman by lawful means.
  • To provide include legal aid, medical, financial or other assistance to a woman who suffer from Domestic Violence or threats.
  • Each service provider shall have the power to record the Domestic Incident Report and forward the copies to the Magistrate and the Protection Officer.
  • To perform medical examination of the affected woman and send a copy of Medical Report to the Magistrate, the Protection Officer and the Police Station.
  • To provide shelter to the aggrieved woman if she request so and forward a Report of Lodging to the Police Station.

Immunity to Service Provides


As the voluntary association which come forward to help the aggrieved woman, it shall be given such protection under the statute in order to avoid unnecessary pressure. Normally, such association are feel the heat of the respondents involved in the dispute. So to insulate such association from the warmth section  10(3) provide protection to the service providers.

The immunity not only extends to voluntary association but also to the members of that organisation. The immunity, thus, provided extend only to the acts done in good faith, in exercise of powers, functions under the Domestic Violence Act.

PROCEDURE FOR DOMESTIC VIOLENCE


Remedies Against Domestic Violence


Background:

In accordance with various International accords such as Vienna Accord, 1994, Beijing Declaration, Platform for Action, 1995, etc., The Domestic Violence Act, 2005 was passed by legislature to protect woman from Domestic Violence. But this not only concerns with the aggrieved woman, also cares about the child of such aggrieved person.

Need of Domestic Violence:

Even though, The Indian Penal Code, 1860, was amended to include section 498A, it was not suffice to fulfill the social demands. The scope of this section was limited only to the husband and his family. There exist no chance for civil remedy if violence was committed by the relationship  of aggrieved person's family.
Therefore, makeup the lacuna in law the Domestic Violence Act, 2005 was passed. Not only husband, but also the relationship of the woman who are members of joint family are included in this act. Hence, the aggrieved person shall raise a plea against any of her relationships. This would mean that even daughters, mothers, sisters are eligible to make an application with the magistrate.

What are Domestic Violence?

Under section 3 of the Domestic Violence Act, 2005, any act or conduct or commission or omission of any act against a women is domestic violence if it satisfy the following conditions

(I) harms or injures or endangers the aggrieved person or tends to do so. It includes physical abuse, sexual abuse, emotional abuse and economic abuse.

(II) To harass, harm, injure to coerce her or any other person related to the aggrieved person

(III) To threaten the aggrieved person to do any of the act mentioned in (I) and (II).

(IV) Injures or causes harm, physical or mental to the aggrieved person.

PROCEDURES FOR DOMESTIC VIOLENCE:

The first and foremost question among anybody to raise a dispute is under which authority the jurisdiction falls or to whom the application to be submitted? Unlike other family dispute, it was not placed under the civil court jurisdiction. The Magistrate is the authority allowed to entertain application regarding domestic violence.

Who to file an application?

Following person are eligible to present an application before the Hon'ble Magistrate. They are
I. An aggrieved person
II. A Protection Officer
III. Any other person on behalf of the aggrieved person

Powers of the magistrate:

Notice:

A Notice shall be issued by a Magistrate to Protection officer, who shall server it upon the respondents and on any other person as directed by the magistrate. The proof of service by the protection officer is a conclusive proof unless contrary is proved. The Notice shall contain the date of hearing of the application under the above said Magistrate.

Counselling:

The Magistrate may call for counselling either singly or jointly for the aggrieved person or respondents. The counseling shall be done by the service providers. The next hearing date shall not exceed two months time.

Welfare expert:

The Magistrate may request a person who is engaged in promoting family welfare for assisting him in discharging his functions. The person so appointed shall preferably be woman.

In Camera Proceedings:

If the Magistrate thinks fit that circumstances of the case warrant in-camera proceedings and parties to the proceedings agree then the Magistrate shall conduct the proceedings in camera.

PROTECTION TO WOMAN DURING PROCEEDINGS:

As per the provision of section 17, the aggrieved woman shall vest with the right to stay in the common household in which she was residing along with the perpetrators of domestic violence. This right is irrespective of title or beneficial interest in the property.
Under no circumstances, the aggrieved woman shall not be evicted or excluded from the enjoyment of shared household or any part of it. Hence, the woman shall have the protection of shelter even if enmity prevail between the aggrieved person and the perpetrators of the crime.
But this claim shall prevail only against husband. Not against any other person who are involved in the act of domestic violence. The “Shared Household” would mean house where husband resides. Hence, it may be one of the followings:

  • House belonging to husband
  • rented by the husband
  • or house which belongs to joint family of which husband is a member
